No proof Nasheed had ordered the arrest of Judge Abdulla: State's attorney

State's attorney on Monday stated that there is no evidence that former President Mohamed Nasheed had given the orders to arrest then Chief Criminal Judge Abdulla Mohamed.

The state prosecutor made the statement at the first hearing of former Defence Minister Tholhath Ibrahim's appeal on Monday, where his attorneys claimed that the judge was arrested on the direct orders of Nasheed.

However, during the 19 day trial in which the former President was found guilty of terrorism, state's prosecutor had stated that the Nasheed had given the order to arrest Abdulla Mohamed, and his verdict noted this well.

Tholhath's defence attorney Mohamed Shah maintained that his client had not been involved in the judge's arrest and that it was carried out by then Male' area Commander, Brigadier General Ibrahim Didi, after being ordered by Nasheed. They further claimed that Colonel Mohamed Ziyad had worked under Didi, in the operation.

Shah further noted that according to the rules and regulations, the President could make such orders as the Commander of Chief and that Tholhath had only acted as a messenger between the former President and commanders.

Furthermore, noting that Ibrahim Didi and Ziyad were acquitted by the Court, Shah said that if the two individuals are not responsible to Judge Abdulla's arrest, neither was his client.

Nasheed was sentenced to 13 years imprisonment in March 2015 for the arbitrary arrest and subsequent detention of Abdulla Mohamed, while his administration’s Chief of Defense Moosa Ali Jaleel was found not guilty of the same charges by the Criminal Court.

Tholhath was sentenced to 10 years imprisonment after being found guilty for the arrest of Judge Abdulla and that his statements and witness testimonies proved that the arrest of the Judge had been planned and executed by him.
