Former President Mohamed Nasheed's team, today,
announced that the United Nations Working Group on Arbitrary Detention
(UNWGAD) has rejected the Maldivian governments's appeal of its decision
in Nasheed's case.
The team - consisting of Ben Emmerson, Amal Clooney and Jared Genser - made the announcement at a press conference held in the United Kingdom by Doughty Street Chambers and Freedom Now on Monday, where Nasheed made his first public comments since imprisonment in March 2015.
After the press conference, Genser said, via his official twitter account, that "today, we announced the UN Working Group on Arbitrary Detention rejected the Maldives government's appeal of its decision in Mohamed Nasheed's case."
Nasheed's international legal team, had back in April 2015, lodged a petition at the UN Working Group on Arbitrary Detention asking for urgent action and formal request for an opinion of the Working Group. Citing several irregularities and non-conformity to rights guaranteed under the Universal Declaration of Human Rights and the International Covenant on Civil and Political Right, UNWGAD had, in October 2015, ruled Nasheed's imprisonment as “arbitrary and unlawful.”
However, the government has dismissed UNWGAD's opnion saying that it “does not accept the decision,” and that it “will not be made to act on the basis of a non-binding opinion.
Following Nasheed's decision to file an appeal at the Supreme Court, the government said that it "has maintained the position that the opinion of the UN Working Group on Arbitrary Detention is one that should be considered by the Supreme Court. This will now be done given that the Court has accepted the appeal already filed by the Prosecutor General, with substantive arguments to be heard at a later date."
While the Maldivian had revealed that it had submitted its response to the Regular Procedure Communication filed by former President Mohamed Nasheed with the UN Working Group on Arbitrary Detention, it did not reveal any details.
